Rite Aid Pharmacy "Service with a Smile" Sweepstakes Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES
The Promotion (also referred to herein as "Sweepstakes") begins on or about 12:01 AM Eastern Time (ET) on March 1, 2010 and ends on February 26, 2011 at 11:59 PM ET (the "Promotion Period"). There are two distinct entry periods: March 1, 2010 - August 31, 2010 and September 1, 2010 – February 26, 2011 (the "Entry Period").
ELIGIBILITY: Participation is limited to individuals who are at least 18 years of age and a legal resident of one of the following states: AL, CA, CO, CT, DC, DE, GA, ID, IN, KY, LA, MA, MD, ME, MI, MS, NC, NH, NJ, NV, NY, OH, OR, PA, RI, SC, TN, UT, VA, WA, AND WV. Employees, directors, immediate families (spouses, children, household members) of Rite Aid Pharmacy, their parent companies, subsidiaries, affiliates, advertising and promotion agencies, and others involved in this Promotion are not eligible.
HOW TO ENTER: There are two methods of entry: (1). Visit Rite Aid Pharmacy's website at www.riteaid.com/feedback and complete the registration and feedback form. Upon submission you will be automatically entered into the Sweepstakes. Rite Aid Pharmacy's computer is the official clock for this Sweepstakes. Proof of entry does not constitute proof of submission. (2). Visitors to any Rite Aid Store may pick up a feedback form at the front register or at the Pharmacy Counter, fill in the required information, and drop the postage paid feedback form into any mailbox. No mechanical reproduced feedback forms will be accepted. In case of dispute, on-line entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
LIMIT: One entry per day, per household, regardless of entry method. Any person who attempts to participate with multiple e-mail and/or street addresses, under multiple identities, attempts to use any robotic device or artifice, to enter multiple times in violation of this entry limitation, will be disqualified.
WINNER SELECTION: The drawing for each of the Entry Periods will be held no more than fifteen (15) days following the end of the Entry Period. Entries will not be carried over into any subsequent Promotion or Entry Periods. The drawing will be performed by an Independent Sweepstakes Administrator, whose decisions are final and binding in all matters related to this Sweepstakes. Winners will be notified by phone, e-mail, or by USPS within approximately five (5) days after each drawing. If a winner cannot be reached, or if a contacted winner does not respond within five (5) days of being contacted, an alternate winner will be selected.
PRIZE: One (1) $1000 Rite Aid Gift Card will be awarded to the winner for each Entry Period. Odds of winning a Rite Aid Gift Card in any Entry Period depend upon the total number of eligible sweepstakes entries received at the time of the drawing. Rite Aid Gift Cards are redeemable for future purchases in any Rite Aid retail location. Purchases may be deducted from the Gift Card until the balance reaches zero. The card does not have an expiration date and is subject to terms contained on Gift Card. The Gift Card is not redeemable for cash, may not be returned, and will not be replaced if stolen. Also, Gift Card may not be used for prescriptions, prescription co-pays, lottery tickets, tobacco, alcohol products, money orders, gift certificates, stamps, licenses, other mailing services and any other items excluded by law. Approximate Retail Value of all prizes to be awarded for the Promotion Period is $2000.
GENERAL CONDITIONS: All taxes on prize are the winner's sole responsibility. An IRS Form 1099 will be issued to the winner. No prize transfer or substitution, except by Rite Aid Pharmacy, in its sole discretion. Winner must sign an "Affidavit of Eligibility, Liability, and where allowed, a Publicity Release" and return within 7 days of notification or prize may be forfeited and an alternate winner selected. By entering the Sweepstakes, entrants agree to all terms and conditions of these Official Rules, and by the decisions of the Independent Sweepstakes Administrator and Rite Aid Pharmacy, which are binding and final in all respects. By entering, entrant gives Rite Aid Pharmacy the rights to utilize submitted comments and entrant names in Rite Aid Pharmacy's future marketing and promotional efforts without any further compensation or release. Winner consents to the use of their name and likeness, and use of any for advertising and promotional purposes for no additional compensation. All federal, state and local laws and regulations apply. All materials submitted become the sole property of Rite Aid Pharmacy. By entering, entrants release and agree to hold harmless Rite Aid Pharmacy, the Independent Sweepstakes Administrator, their respective parents, subsidiaries, affiliates, agencies and the officers, directors, employees, agents and representatives of these entities from any and all liability arising from, or in connection with participation in the Sweepstakes or the receipt, possession, acceptance or use/misuse of the prize offered. Any attempt by an entrant or any other individual to tamper with, deliberately damage or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Rite Aid Pharmacy reserves the right to prosecute and seek damages from any such individual to the fullest extent permitted by law (in addition to disqualification of such individual if an entrant).
LIMITATIONS OF LIABILITY: Rite Aid Pharmacy and its agents and affiliates are not responsible for: any incorrect or inaccurate entry information, human error, technical malfunctions, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, service providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes, inability to access the survey site, theft, tampering, destruction, or unauthorized access to, or alteration of entries, transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website, printing or human errors, and any mailed entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible or mailed postage due, or any combination thereof. Rite Aid Pharmacy reserves the right to terminate, modify or suspend the Promotion at their discretion and select the final winner from all eligible entries received up to the time of termination. Notice of such action by Sponsor will be posted on www.riteaid.com/feedback.
WINNERS LIST: To receive written confirmation of the winners, mail a self-addressed stamped envelope to Rite Aid "Service with a Smile" Sweepstakes Winner Confirmation, PO Box 25497, Rochester, NY 14625. Requests must be received by 5/1/2011.
